Legal Separation

Yes, Georgia does recognize a form of legal separation: It is called "Separate Maintenance" and you and your spouse can agree to an equitable division of property and support and enter into an agreement that will survive whether you remain married or divorce. Separate Maintenance is an excellent means of preserving a spouse's right to a share of a pension, insurance benefits and the like, without having to remain living as husband and wife. This is one form of a Post-nuptial Agreement that can be filed in Court and approved and ordered by the Court.
