Modification

As a former spouse you may have the legal right to seek to reduce the child support or alimony that you pay. You may also seek to change the custody or visitation for yourself or the other parent.

We Stone Judgehandle change of custody cases, technically known as "modification" of custody. A modification of custody is permitted where there has been "a substantial change of circumstances." A "substantial change in circumstances" can include a change in residence, one parent moving out-of-state, remarriage, cohabitation, use of drugs, change in housing, physical or mental illness, recovery from physical illness or many other changes. A non-custodial parent always has the right to seek physical custody of his or her child.

Alimony and child support may also be increased or decreased by the court, depending in part, on any settlement agreement that you may have signed.

Courts have the power to modify existing child custody arrangements to meet the needs of the child and to respond to other changes in the parents' lives. Even visitation can be modified to make spending time with your children more enjoyable.
